Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the NexiphorVerifier email verification service, including our website, dashboard, and API (collectively, the "Service"). By creating an account you must actively accept these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. The Service

NexiphorVerifier validates email addresses you submit and returns a verification result (such as Valid, Invalid, Catch-all, or Unknown) together with supporting metadata. Results are provided on a best-effort basis. Email deliverability depends on factors outside our control, and we do not guarantee that any address we report as valid will accept mail, or that any address we report as invalid will reject it.

3. Accounts

You must provide accurate registration information and keep your credentials and API keys secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use. You must be at least 18 years old to use the Service.

4. Credits, Billing & Payment

The Service operates on a prepaid credit model. Verifications consume credits as described on our pricing page. Payments are processed by our payment provider, Stripe; we do not store your full card details. You are charged only for verifications that return a conclusive result. Syntax-invalid addresses are never charged, and verifications that end in an Unknown or Failed state are automatically refunded to your credit balance. 5. Acceptable Use

You agree not to use the Service to:

  • Verify email addresses you have no lawful basis to process, or that were obtained through unlawful means;
  • Support the sending of unsolicited bulk email (spam) or any activity that violates anti-spam laws such as GDPR, CAN-SPAM, or CASL;
  • Harass, defraud, or harm any person, or attempt to identify or profile individuals without consent;
  • Reverse engineer, resell, or abuse the Service, circumvent credit metering, or place automated load beyond your plan's documented limits;
  • Violate any applicable law or the rights of any third party.

You are solely responsible for having a lawful basis to process the email addresses you submit. We may suspend or terminate accounts that violate this section.

6. Refunds

Refunds and credit adjustments are governed by our Refund & Credit Policy, which forms part of these Terms.

7. Service Availability

We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free. We may modify, suspend, or discontinue features with reasonable notice where practicable.

8. Intellectual Property

The Service, including its software, models, and branding, is owned by NexiphorVerifier and protected by law. You retain all rights to the email lists and data you submit; you grant us a limited license to process that data solely to provide the Service to you.

8a. Support, chat, and AI copy

Human support chat, in-app messages, and any AI-assisted email copy are operational communications. They are not a contract amendment, SLA, legal advice, or a billing commitment. Only these Terms, the Refund Policy, and an order you complete in checkout bind us.

9. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind. NexiphorVerifier will not be liable for any indirect, incidental, or consequential damages, or for lost profits or data. Our total liability for any claim arising from the Service is limited to the amount you paid us in the three months preceding the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access for breach of these Terms. Unused credits are handled as described in the Refund & Credit Policy.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Germany. Courts in Frankfurt am Main shall have exclusive jurisdiction, without prejudice to mandatory consumer protections that may apply in your country of residence.
